ABSTRACT

The common law places few restrictions on the performance of construction work, and the arrangements that a land owner may make to have construction work performed on his land. This chapter consideration is given to the questions of 'when' work may be performed, the planning and other consents that need to be secured; 'how' work may be carried out, the statutory restrictions which determine the minimum standards to which work must be performed; Primary consideration is given to the usual scenario of where a person wishes to carry out work for their own benefit. This is to be distinguished from certain situations, which will not be considered here in any detail, of where a statute positively requires a person to carry out construction or engineering work and 'by whom' construction or engineering work may or may not be performed, and whether a person needs to be licensed or accredited in order to carry out particular work.
