ABSTRACT

While it is the builder’s exclusive obligation to construct and complete the vessel in accordance with the contract and the specifications, it is customary in shipbuilding projects for the buyer to be permitted continuously to monitor the progress of the contract works. For this purpose the buyer is usually afforded two distinct contractual privileges:

(a) the right to approve in advance the builder’s detailed plans and drawings for the vessel; and

(b) the right to be personally represented at the shipyard by resident supervisors who are contractually entitled to inspect and approve the contract works.
