ABSTRACT

This chapter examines the behaviour that is directly related to attacks on the integrity of data. It focuses on four issues that overlap to an extent namely Destroying data, Inappropriate access to data, Unlawful disclosure of data and Interception of data. The first type of behaviour to consider is that which relates to the destruction, disclosure or accessing of data. By focusing not on the authorisation of the access but rather whether it constituted misconduct it means that the debate about whether asking a third-party to look at data constitutes an offence under the Computer Misuse Act 1990 becomes irrelevant. The final issue to consider is that of intercepting data. The Interception of data is an issue that is specifically addressed by the Cybercrime Convention. Each party shall adopt such legislative and other measures as may be necessary to establish as criminal offences under its domestic law.
