ABSTRACT

Formally, the CA48 emerged from a five year generative process starting with the establishment of the Cohen Committee. The recommendations in the Cohen Committee report were enacted in CA47 which was then combined with the remaining provisions of the earlier consolidating act, CA29, to give the new consolidating act, CA48. This process thus provides the immediate generative background to CA48. An understanding of the provisions of CA48 thus requires a detailed understanding of this process, that is how CA48 actually came to be created in its observed form. The establishment of the Cohen Committee has been described in an earlier chapter (Chapter Four). Important though that step was in the creation of the new legislation, however, the form and content of the legislation only emerged thereafter in the generative process of the report and the subsequent parliamentary process. It is this generative process that is considered below.
