ABSTRACT
WHEREAS, the Contractor, itself or through qualified Subcontractors, desires to provide all the services necessary for the design, engineering, procurement, construction, commissioning and testing for the Facility [including Integration of the New Facility with the Existing Plant (as defined herein)]6 [{in accordance with the requirements of this Contract}]7 on a fixed price, lumpsum, date certain, complete and fully integrated “turnkey” basis;
NOW, THEREFORE, in consideration of the mutual promises contained herein, the Parties, intending to be legally bound, hereby agree as follows.
