ABSTRACT
During the performance of the Work, the Contractor may identify a more cost-effective means to achieve the Facility’s performance objectives that would require a modification to the Functional Specifications. If so, the Contractor shall promptly notify the Sponsor and provide the Sponsor with a complete analysis of the proposed change, including installed and operating cost differences and project and payment schedule impacts. The Sponsor shall review the analysis of the proposed change and notify the Contractor of a decision within <<insert number>> Days after receipt of the Contractor’s notice. If the change is accepted by the Sponsor (although the Sponsor shall have no obligation whatsoever to consider or accept such proposal), the Contractor shall receive a fee equal to <<insert number>> percent of the reduction of the Contract Price, and the parties shall execute and deliver a Change Order reflecting the effect of the proposed change on the Project Variables.
