ABSTRACT

Max Weber gives a central place to the Western cities in the development of capitalism. He approaches the distinction of the city on the basis of patrimonialism and rationalism. He establishes a basis for the Oriental Occidental comparison of the city and develops explanations about its beginning to demonstrate the unique nature of Europe. In addition to these explanations, Weber emphasizes the urban character of early Christianity. According to him, the source of this thought comes from the Roman and Greek roots of Western civilization, where the idea of natural law emerged and was developed by Christianity. When it comes to the effect of Roman law on modern rational law, Weber pays extra attention in examining the development of Islamic law in comparison with that of the Western. According to him, with the help of the conceptualization of Stoic natural law, the formal components of Germanic law established the first legal system within the frame of the rational Roman traditions.
