ABSTRACT

Medical researchers are hostile towards laws that protect privacy, For example, in November 2000 the Health Service Journal reported on a campaign by cancer epidemiologists led by Professor Peto that called for all medical research to be exempted from the UK Data Protection Act 1998 and for the common law on confidentiality to be relaxed. 'Cancer Experts Call for Action on GMC's Confidentiality Rules', 2 November 2000 Health Service Journal. According the Court, unfair treatment is treatment contrary to the legitimate interests of the patient, and in: a case like the present which involves personal confidences, the concern of the law is to protect the confider's personal privacy. A different conception of privacy is to be found in the jurisprudence of the European Court of Human Rights and the Commission on Human Rights of the Council of Europe.
