ABSTRACT

In the Hamlyn Lectures on Commercial Law in the Next Millennium, Professor Roy Goode drew attention to the fact that initially it was the delays and expense associated with litigation that had led to the growth of commercial arbitration, which was expected to be fast, flexible, informal, private, relatively inexpensive and conducive to finality'. As far as the Italian situation is concerned, the section of the Italian Code of Civil Procedure regulating arbitration is silent on the matter. On the other hand, the Arbitration Rules of the Arbitration Chamber of Milan updated as from 1 January 2004, still contain a specific article on confidentiality. The entrance and the exit symbolize the acts of entering life and passing away respectively while the two-faced head of Janus, located above the entrance door, represents the flowing of life from one stage to another, from birth to death.
