ABSTRACT
Consent appears throughout the criminal law in New Zealand as a concept that demarcates criminal behaviour (assault, sexual violation and theft) from non-criminal behaviour (a hug, sex and a gift) in relation to particular violence and property offences. Consent is not defi ned in the legislation and whether it is present or absent largely tends to be treated as a factual issue for jury determination.
