ABSTRACT
The cases briefed in this chapter establish that the right to counsel is a basic right that must be observed by the police if the contact can be characterized as a critical stage, as the above cases illustrate. On the other hand, questioning during stops or while issuing traffic citations does not trigger the right to counsel because those are not critical stages in a criminal prosecution.
