ABSTRACT

So far in this book, we have been looking at private trusts, i.e. trusts for ascertainable individuals. Express trusts, resulting trusts and constructive trusts are all types of private trust. We come to charitable purpose trusts (also called public trusts) in the next chapter. This chapter is concerned with private purpose trusts, sometimes referred to as non-charitable purpose trusts. With a few exceptions, private purpose trusts are void and we need to know why.
