ABSTRACT

Ageing is one of the most significant changes affecting contemporary societies everywhere, imposing certain burdens, such as the increasing number of people with dementia.2 This change in the citizenry means new challenges also for legal systems across the globe. Elder law3 has in many different ways tried to provide safeguards for the rights of such people. Special attention has been paid to the significance of the need for protection and the right to autonomy as judicial decision-making principles. This chapter analyses the autonomy of a person with dementia and how the law operates in situations where it is necessary to restrict such a person’s freedom.
