ABSTRACT

Many people use the terms obscenity and pornography as if they are interchangeable terms, but they are not. Obscenity(from the Greek for “filth”) is a legal term used to describe sexually explicit material that is so offensive that it does not deserve First Amendment protection. Pornography (from the Greek for “writing about prostitutes”) is actually an artistic term rather than a legal term and describes a broader category of material that is sexually arousing, but not to the degree of being obscene; pornography still receives limited First Amendment protection. There are many examples of books and movies that could be considered pornographic but not obscene.
