THE INSTITUTIONAL SETTING Formal Institutions As we have seen in Chapter 3, the constitutional foundation of environmental policy is the Commerce Clause, which provides the federal government with the authority to regulate interstate commerce. As this chapter will show, the three formal institutions of the federal government are intricately involved in environmental policy.
