ABSTRACT

Under most construction and engineering contracts, it will usually be an express obligation, if not possibly an implied obligation,41 on the owner’s part not to revoke any licence granted to the contractor to occupy the site, or the relevant parts of the site, whilst the contractor is performing its contracted work, other than in accordance with terms of the contract.42 A contractor will not ordinarily have a proprietary interest in the land upon which it is working, but at the same time it will usually have been promised by the owner, under contract, that the contractor’s licence will not be revoked during the proper performance of the works.
