ABSTRACT
Organ transplantation can often save and transform the quality of a person's life. Organs are transplanted into patients who are on an organ donor waiting list, but there is an acute shortage of available organs in the UK a situation which we will examine in this chapter. One of the most fundamental issues addressed in the provisions of the Human Tissue (HT) Act 2004 is the issue of consent. It is possible that schemes to create incentives for people to donate their organs could be introduced, or that consent could be presumed. There is compelling evidence to suggest that presuming patients' consent to organ donation would increase donation rates. The reality is that there are insufficient organs to meet the demand of those patients on the organ transplantation. Hence methods need to be introduced to increase the supply to help improve lives of patients on dialysis or save the lives of those patients who cannot survive without a transplant.
