ABSTRACT

Generally, the source from which a construction contractor purchases materials or goods for contract works is entirely a matter for him to decide. However, for reasons similar to those for the use of Nominated Sub-contractors, many construction contracts contain provisions whereby the contract administrator selects a supplier of certain materials or goods for the contractor to use. Suppliers engaged in this manner are referred to as ‘nominated suppliers’. They do not carry out any work or fixing of materials on site. The aim in this chapter is to explain the JCT 98 provisions on Nominated Suppliers. For simplicity, the word ‘materials’ is used hereafter to cover materials and/or goods.
