ABSTRACT

The second and current edition of the conditions was introduced in 1995 to provide consistency with changes to the Institution of Civil Engineers Conditions of Contract used on major civil engineering projects. The employer must appoint an individual to act as the engineer and inform the contractor accordingly. The engineer, upon the written request of the contractor, may need to specify under which of the foregoing powers any instruction is given. The contractor must take all reasonable steps to minimise any delay. Payments are to be made monthly, using information supplied by the contractor as a basis. Neither the employer nor the contractor can assign the contract without the written consent of the other party. The contractor must comply with all notices required by statutory authorities and pay all fees that may be necessary. The contractor is to maintain an insurance in the joint names of the employer and the contractor, for both the permanent and the temporary works.
