ABSTRACT

This chapter discusses the concept of dishonesty and an intention by the defendant to gain the fraud by failing to disclose the information in the Fraud Act. It provides that a person who commits an offence: dishonestly fails to disclose to another person information under a legal duty to disclose and intends by failing to disclose the information. The actus reus of the offence is failure to disclose information that applies under a legal obligation. The chapter explains the blackmail offence within the Theft Act and it states that a person is guilty of blackmail to gain for himself or another or with the intent to cause loss to another who makes any unwarranted demand with menaces. A person guilty of blackmail shall on conviction on indictment be liable to imprisonment for a term not exceeding fourteen years. This chapter also deals with the mens rea elements of the offence to make a gain or cause loss dishonestly.
