ABSTRACT
Article 82 of the EC Treaty applies only to firms that have dominant market power, and seeks to prevent the abuse of such power for anti-competitive ends. It prohibits the abuse of dominant market power either by the unilateral conduct of a single dominant firm or by the independent action of several oligopolists. It is the abuse of a dominant position that is prohibited, rather than the dominant position itself.
