ABSTRACT

This chapter considers the law as it applies to three of the major groups of consultants, being architects, engineers and surveyors. Consultant is to describe a person who provides purely services for a construction or engineering project, as opposed to supplying materials and performing work with them. Other matters that are usually covered by a consultant's appointment include: financial limitations on the consultant's liability; insurance that the owner requires the consultant to have in place and maintain; warranties that the consultant is to provide in favour of the owner. An engineer is under an obligation to produce a design which meets the requirements of his client and where the engineer has an active role in the delivery of the project, it is the engineer's obligation to ensure that his design is carried out. Surveyor when used in relation to construction projects, describes a professional who specialises in assessing the condition, cost or value of a building or building work.
