Representations by third parties

There are, therefore, two principal ways in which the representation by a third party may engage the defendant’s liability in deceit. First, the defendant may have used the third party as a means to perpetrating the fraud.5 Secondly, the defendant, even if personally innocent, may be vicariously responsible for the fraudulent misrepresentation made by his or her agent or employee.
