In addition to the provisions previously discussed, the contract may, depending upon the circumstances in which it was concluded, contain a number of other miscellaneous terms. These may be either negotiated by the parties on an ad hoc basis, or already form a part of the standard form they have elected to use. Such provisions typically concern (i) suspension of the work; (ii) environmental protection; (iii) confidentiality; and (iv) exclusions and limitations upon the builder’s liability.
