Of the above three options, the most likely scenario is the first, namely that the broker is taking its instructions from one of the parties and being remunerated by that party but is dealing directly with the other party to the transaction. Typical examples would be the yacht-broker acting for the buyer
of a yacht dealing directly with the yard for the construction of a new yacht, or the broker acting for the owner of a yacht dealing directly with the charterer. Again, the broker will be the agent of the party giving it instructions.
