ABSTRACT

Social justice is more than a concept. Social justice has moved through legislative bodies and the courts to establish protections for those who are young and old. Through redistribution, equality, the common good, and the progressive agenda, social justice offers protections in the workforce as well as constitutional rights. Legislation such as the Age Discrimination in Employment Act (ADEA) and the Fair Labor Standards Act (FLSA) protect workers both young and old. Landmark cases such as Tinker v. Des Moines Independent Community School District (1969), Hazelwood School District v. Kuhlmeier (1988), New Jersey v. T.L.O. (1985), and Fare v. Michael C. (1979) impact the rights of minors.
