ABSTRACT

The use of violence to advance any political cause is anathema in any liberal democratic society. Indeed, it is contrary to its core values and principles such as freedom of expression and conscience and consensus decision-making, which allows for open discussion and debate on all political issues and concerns and that the most persuasive arguments resolve the questions of the day, provided that they adhere to the rule of law and principles of fundamental justice. Terrorism, the deliberate and random denial of everyone’s most fundamental human rights and human dignity, the right to life itself, can only be combatted effectively through the defense and advance of human rights and most effectively, likely, through criminal law and, ultimately, the judgments of the final courts of appeal, and in Canada, the Supreme Court of Canada (SCC). 1
