ABSTRACT

Chapter 5 looks at the nature of design and its influence on a constructed facility. As an intellectual exercise, design “deliverables” are intellectual property. Identified design risks discussed are scope, time, cost, design quality, intellectual property, interfaces and designer’s insolvency, as well as client risks identified by the International Federation of Consulting Engineers (FIDIC). Who should bear these risks, and management of risks by the Employer and the designer is discussed.
