ABSTRACT

This chapter is concerned with the way in which code rights affect successors. It is divided into three broad sections: An introduction to land registration concepts; The Old Code and land registration; The New Code and land registration. Land registration has existed in England and Wales, in one guise or another, for many years. The rules about land registration are set out in the Land Registration Act 2002. Most freehold estates in England and Wales are registered at Land Registry. Many long leasehold estates are also registered with their own title at Land Registry. The 1984 Act was the first legislation to create a code regulating the installation and operation of telecommunications apparatus upon land. At that time, telecommunications were in their infancy. The introduction of the New Code was preceded by two detailed consultations calling for suggestions for improvements to the Old Code, amongst which the question of registrability was raised, albeit perhaps not expressly enough.
