ABSTRACT

Part 5 of the New Code deals with the procedure for the termination and modification of code agreements. This chapter deals with the modification of code agreements. There is plainly a degree of cross-over between paragraphs 31 and 33. Each describes a process which may ultimately result in an order under paragraph 34, providing for continuation of the existing code right for a specified period, with or without modification of other terms of the code agreement; modification of the existing code agreement to provide for the addition or deletion of a code right; or entry into an entirely new code agreement. In practice, the only outcome which the procedure under paragraph 33 does not allow is actual termination with no further agreement, for which resort must be had to paragraph 31, with its various grounds for termination.
