ABSTRACT

One the major advantages of Distributed Leger Technology that is touted by promoters is the enhanced level of privacy that accompanies the product. This chapter outlines various approaches to regulating privacy in a private context. It illustrates how the Privacy by Design approach can help to mitigate some of the risks associated with the publicly accessible Blockchains vis-a-vis their susceptibility to infringements of individual privacy rights. The chapter discusses some of the legal developments in the regulation of private law privacy rights and the impact that this will have with respect to the General Data Protection Regulation and similar regulations that are set to take effect around the world. As cryptocurrencies are used for illicit purposes, calls for regulation have been made in order to bring exchanges and cryptocurrency developers under the rubric of the existing anti-money laundering regimes.
