ABSTRACT

This chapter provides the international drug control system by presenting its source and its institutions. The international drug control system is evolving constantly due to the myriad of legal instruments adopted by the various actors. Capturing the legal relevance of the soft law instruments of the international drug control system is far from self-evident. International drug control is not only 'treaty based', but also partly 'charter based'. The central actors within the international drug control system are the United Nations General Assembly (UNGA), the Economic and Social Council of the United Nations, the CND and the WHO. International drug control is discussed within the UNGA's third committee, which is concerned with social and humanitarian issues. The normative value of UNGA resolutions under the UN Charter has been the subject of long and vivid debates among legal scholars, as well as States.
