ABSTRACT

This chapter presents the basics of a good notice. These include: state the area and location of the problem; identify the relevant provisions of the contract under which specialist subcontractors are giving notice; and the Joint Contracts Tribunal (JCT) contracts refer to 'Relevant events'. These also include: state what action specialist subcontractors require from other parties in order to avoid or reduce the effect of the delay. Whereas the New Engineering Contract (NEC) contracts refer to 'Compensation Events'. The requirements of most subcontract conditions are very similar. There will be a when, a what, a who and a mechanism. It boils down to this – specialist subcontractors must notify the Contractor/Client immediately there is a 'problem', partly because, in theory at least, the Contractor will take action to resolve the problem so that specialist subcontractor’s works can proceed without delay.
