ABSTRACT

As might be expected, generators treating hazardous wastes by an exempted method have few requirements to abide by, with respect to the exempted portion of their operations. However, blanket exemptions from the regulatory requirements are rare. Most exemptions or exclusions have definite limitations in terms of their nature, scope, and application. Many are conditional in nature, with the exclusion available only if all conditions are met. It is recommended that generators utilizing any of the exempted treatment methods take the effort to document the factual circumstances and rationale behind the decision that the exemption was applicable and legally available to the firm.
