Finding and selecting a treatment or disposal facility that (1) is competently managed, (2) is in compliance with the applicable regulatory standards, (3) poses manageable and acceptable risks to human health and the environment, and (4) possesses the permits, equipment, and expertise necessary to handle a particular waste is crucial to corporate compliance and limitation of liability. However, the regulations do not provide much guidance to that end, nor will regulatory agencies typically recommend any one firm over others.
