ABSTRACT

The Alternative Dispute Resolution (ADR) movement, with its various mechanisms, comes into the picture at this point. In recent years there has been a call for thinking beyond the legal system as to the values of justice it embodies. This movement seeks to work through disputes in a manner different from the classic legal manner, while preserving the shared values of alternative justice and alternative language, alongside new forms of ethics and social order. This chapter demonstrates and analyzes the phenomenon of the entrance of the alternative language with its alternative values of justice into the current discourse surrounding divorce disputes involving violence against women, alongside its actual influence (as well as its potential future influence) on such disputes. The focus on interests-based negotiation is likely to be expressed in the alternative practice of the integrative problem-solving court for domestic violence.
