ABSTRACT

This chapter proposes two relatively innovative Alternative Dispute Resolution (ADR) mechanisms as optional solutions for battered women engaged in divorce disputes involving violence: med-arb and online mediation. As ADR mechanisms and part of the ADR movement, these mechanisms rely upon the alternative justice values and language and as such their application to disputes of this nature is likely to provide an appropriate alternative to judicial justice and litigation and to address the criticism of judicial justice in dealing with the phenomenon. According to the researchers, it may be concluded that there is real potential here for a solution to legal disputes in a just and fair manner and that the results of the study demonstrate that the use of online mediation for divorce disputes may certainly serve as a practical alternative. A further independent advantage of online mediation in divorce disputes involving violence is the empowerment of the battered woman.
