ABSTRACT

This chapter explores the legal issues arising from the development of algorithms to automate and replace professional advice and decision-making in government and commercial contexts. Automated algorithms make decisions that can breathe a new level of power into businesses and governments. A number of countries around the world are working on the problems of accountability of algorithms and the ethical use of artificial intelligence. The explosive growth of data collection, coupled with increasingly sophisticated algorithms, has resulted in a significant increase in automated decision-making, and a greater reliance on algorithms in human decision-making. Automation of decision-making through application of machine learning algorithms is one way to pursue efficiency and accuracy. A major problem with algorithms, algorithmic bias and technology generally is that in many domains, they are held to a higher standard than humans undertaking similar functions. A number of countries around the world are working on the problems of accountability of algorithms and the ethical use of artificial intelligence.
