ABSTRACT

Although the state imposes mandatory education on children up to the age of 16 it does also require Local Education Authorities (l.e.as.) to provide facilities for those young persons between the ages of 16-19 who wish to continue their education, whether in school or some other institution. A campaign is being waged at the moment to have the 1944 Act amended to ensure that all l.e.as. should at least provide an accessible and basic adult education service. The polytechnic tried to extract itself from this legal mire by putting a plan to the court which would have involved formalised separate teaching for Harrington. Some confusion has arisen over the legal status of halls of residence and the occupation rights enjoyed by students. A tenancy could exist but a more likely possibility is a contractual licence which is enforceable by the student through a decree of specific performance.
