ABSTRACT

Education cuts have been a major factor in promoting legal disputes. There are forces at work within the world of education which must bear a large degree of responsibility for the increase in educational litigation. Inter-union politics have added to the atmosphere of legal controversy. There have been several cases involving the degree of recognition to be afforded by employers to the APT. Without a doubt the major factor behind the growth of education related litigation has been the breakdown of the education between parents, teachers, local education authorities and central government. Ironically the law itself must bear some responsibility for the expansion in education litigation. The enforcement of legal rights within the education world is supported by a host of pressure groups eager to score points. Allied to the legal trends it should be reiterated that the vague drafting of several key provisions in the Education Act 1944.
