ABSTRACT

This chapter explores ethical concerns surrounding organ transplantation and organ donation. The distinction between ethics of justice and ethics of care is made and so is one between a social concept of morality and Socratic conception of morality. One lays stress on altruism while the other may or may not have room for it and primarily focuses on living well. We ask whether body or organ can be considered a property? It is assumed that in India complete negation of right over one’s organ might not be entertained. Legal provisions of organ donation in India are discussed besides arguments both for and against compensated organ donation. We try to understand about the connect or rather disconnect between law and morality via the laws about organ donation in India.
