ABSTRACT

This chapter explores Ambedkar’s vision for the law. It is one where a law is a command but this command must be carried out not only in the legal sphere of the state but also in the social sphere where the caste system prevailed as the law. So in a way, he was propagating a law beyond the law of the state. According to him, due to a majoritarian bias, a law must be mobilized on the side of right and morality. Making untouchability a criminal offence was central to Ambedkar’s concept of law. Abolishment of untouchability became a fundamental right in the Indian constitution as per Article 17. Ambedkar believed that constitutional morality had to be cultivated in India.
