ABSTRACT
Chapter 3 explores the theory that ballot access laws undermine third parties. The chapter demonstrates that while ballot access laws have indeed gotten more difficult since around 1900, these laws have had little impact on the ability of third parties to either get their candidates onto the ballot or to win votes. The chapter also shows that while ballot access laws remain difficult by historical standards, third parties have been getting onto the House ballot in increasingly high numbers over the past few decades.
