ABSTRACT

Case law is created on a daily basis by all levels of the court system. Generally, larger states produce more case law because there are more cases. Although the executive and legislative branches "make" the laws and regulations, it is the judicial branch that interprets and applies the laws and regulations, Through the numerous and varied cases hear before the courts, case law has developed doctrines that provides guidance as to the application of a particular law or regulation. Over appellant's objection, the trial court excluded, as immaterial, testimony relating to appellant's mission "to preach the true facts of the Bible," his treatment at the hands of the crowd, and the alleged neglect of duty on the part of the police. This action was approved by the court below, which held that neither provocation nor the truth of the utterance would constitute a defense to the charge.
