ABSTRACT

This chapter is concerned with the implications of using more than one liability rule by the courts. It demonstrates that when a court uses more than one liability rule for apportioning liability between parties and there is uncertainty regarding which rule will be used, then inefficiency is possible even if all the liability rules are efficient.
