ABSTRACT

This chapter examines the implementation mechanisms of right to development (RTD). It identifies the duty bearers and rights holders of the right. The chapter explores that the beneficiaries of the right are individuals, peoples as well as the state. Under the Maastricht Principles, the state is presented as the primary duty bearer of human rights and this approach equally applies under the RTD discourse. The international community should promote an effective international co-operation for the realisation of the right to development and the elimination of obstacles to development. Global institutions such as the international financial institutions and the World Trade Organisation that shape development agendas around the world have the responsibility to ensure that their activities do not hamper the realisation of the RTD. A transnational company is a company operating beyond national boundaries or operating in different countries. The traditional duty bearer of rights which is the state is also a beneficiary of human rights in RTD discourse.
