ABSTRACT

Harassment including sexual harassment in terms of a person subjecting a woman to harassment, on the grounds of her sex, where a woman's dignity is violated or there is an intimidating, degrading, humiliating or offensive environment. The sexual offences Act 2003 introduced new offences including responding to new challenges posed by twenty-first century technology and by strengthening measures to combat the sexual exploitation and trafficking of children. Downloading pornography may be illegal under the Obscene Publications Act 1959 or, where child pornography is involved, under the Protection of Children Act 1978. Employers must be able to distinguish between someone who seeks to find illegal material and someone who inadvertently clicks on an email link. Even chief executives of well-known companies are not protected from dismissal when they indulge in objectionable internet practices. Clear rules should be laid down in relation to what materials, photos, magazines, and images, are permitted and not permitted at work.
