ABSTRACT

During the political-economic transition, data protection in Hungary became an important element of the rule of law and an essential part of human rights. This chapter provides a brief overview of the main pillars of the Hungarian data protection norms, including the Data Protection Act with its amendments. Protection of personal data is guaranteed in the Hungarian Constitution among the fundamental rights of the citizens. In Article 83 of the Hungarian Civil Code it is stated that processing and handling of personal data shall not violate personal rights. The data subject has the right to the request for communication on the processing of his or her personal data, as well as to request for rectification of his or her personal data, or their deletion except those already processed according to provisions of law. In case of infringement of his or her rights, the data subject may institute court proceedings against the controller.
