ABSTRACT

This chapter utilizes the Giving Voice to Values (GVV) framework to discuss how to address values conflicts in the legal profession. It examines what is at stake for the key parties? The chapter also examines what arguments or rationalizations will the person wishing to voice his or her values likely encounter; and what strategies can the person wishing to voice his or her values use to counter these arguments and plot a course of action? Stakeholders can be divided into two groups: internal stakeholders and external stakeholders. The GVV framework refers to the responses as "reasons and rationalizations." Four of the most common rationalizations are: standard practice/status quo; materiality; locus of responsibility; and locus of loyalty. The chapter explores each of these in conjunction with the legal scenarios. In the GVV context strategies are a set of methods designed to accomplish a particular outcome. The chapter addresses the four main strategies: reframing; bridging the gap; building coalitions; and listening.
