ABSTRACT

However, the Pakistani Supreme Court lacks justiciability standards as well as a filtering procedure for petitions, which has left the Court overworked and subject to the desires of each Chief Justice. The negative impact of this was felt during the hyper-activism of the Supreme Court under the leadership of Chief Justice Iftiqhar Chaudhry. This hyper-activism destabilized the trichotomy of powers in many ways, but two areas merit special consideration: the appointment of judges and the disqualification of the President or Prime Minister.
